Zuhr as a Hanafi?

Answered as per Shafi'i Fiqh by Qibla.com

Answered by Shaykh Hamza Karamali, SunniPath Academy Teacher

Scenario: A person non-deliberately misses the zuhr salat, but at the same time there remains 10-15 minutes before the zuhr time exits according to the Hanafis. Can this person pray zuhr like a Hanafi, (instead of performing the missed salat as a makeup) whilst fulfilling all the fara’id and wajibat of tahara and salat according to the Hanafi madhab?

Answer:
In the Name of Allah, Most Gracious, Most Merciful

In the Name of Allah, Most Merciful and Compassionate

The person could pray a Hanafi zuhr prayer if he wanted to, and if he did so, he would have fulfilled his responsibility before Allah, since one may follow any one of the four Sunni schools of fiqh. If, however, there was a valid excuse for missing the prayer, there wouldn’t be any need to follow the Hanafi school, since one is not sinful for missing prayers if one has a valid excuse for doing so. One would simply make up the prayer before performing the asr prayer and then pray the asr prayer.

What is a valid excuse?

In the Shafi‘i school, there are only two excuses for missing the prayer:

1. Sleep (provided either that (1) one falls asleep before the prayer time enters and remains asleep until it exits, or (2) one sleeps after the prayer time entered, confident that one would be able to wake up and perform it before it exited, but ends up oversleeping).
2. Forgetfulness.

And Allah knows best.
