Waiting for the congregation for a person of chronic annulment of wudu

Answered as per Shafi'i Fiqh by Qibla.com

Answered by Ustadha Shazia Ahmad

I am a person with continuous annulment of wudu due to hadath (ritual impurity). Is it necessary for me to pray at the first of the prayer’s time? The jama’ah in our city happens sometimes forty five minutes after the time of prayer comes in. Should I wait for the jama’a or should I pray alone at the earliest possible time?

Answer:
In the Name of Allah, Most Gracious, Most Merciful

If you want to pray alone, it is not legally necessary that you pray at the first of the prayer’s time. Rather, what is obligatory [in a state of chronic annulment] is that you pray immediately after you have performed your purification process (which was performed) after the time of the prayer entered. This process includes washing the filth, applying an absorbent and a dressing, and then making wudu. You should hasten to pray immediately after this.

If you want to pray with a congregation, it is permissible for you to wait for the congregation and pray with them, even though you have continuous annulment of wudu. It is permissible to wait for the congregation even if it takes a very long time, or even if the most of the prayer time passes in waiting for it. (Hashiyat al-Jamal, 1/244)

And Allah knows best.
