Shar’ee Ruling on Mother Living with Son After Marriage

Q: What is the Shar’ee ruling regarding a mother living with her son after his marriage?

Bismillaah

A: We are commanded in ​Shari’ah to serve our parents, be kind to them and at all times to see to their welfare. More so, when they reach old age and they are unable to take care of themselves, then it become obligatory upon the children to fulfil their needs and take care of them.  Hence, if one’s parents wish to come and stay with one, then it is only in keeping to the beautiful teachings of Islam that one expresses happiness and seizes this golden opportunity in serving them.

And Allah Ta’ala (الله تعالى) knows best.

وَقَضَىٰ رَبُّكَ أَلَّا تَعْبُدُوا إِلَّا إِيَّاهُ وَبِالْوَالِدَيْنِ إِحْسَانًا إِمَّا يَبْلُغَنَّ عِندَكَ الْكِبَرَ أَحَدُهُمَا أَوْ كِلَاهُمَا فَلَا تَقُل لَّهُمَا أُفٍّ وَلَا تَنْهَرْهُمَا وَقُل لَّهُمَا قَوْلًا كَرِيمًا ﴿الإسراء: ٢٣﴾

وَإِذْ أَخَذْنَا مِيثَاقَ بَنِي إِسْرَائِيلَ لَا تَعْبُدُونَ إِلَّا اللَّـهَ وَبِالْوَالِدَيْنِ إِحْسَانًا ﴿البقرة: ٨٣﴾

عن عبد الله بن عمرو قال قال رجل للنبي صلى الله عليه وسلم أجاهد قال لك أبوان قال نعم قال ففيهما فجاهد (صحيح البخاري #5972)

عن عبد الله بن عمرو عن النبي صلى الله عليه و سلم قال رضي الرب في رضى الوالد وسخط الرب في سخط الوالد (جامع الترمذي #1899)

عن أبي أمامة أن رجلا قال يا رسول الله ماحق الوالدين على ولدهما قال هما جنتك ونارك (سنن ابن ماجه #3662)

وعلى الرجل أن ينفق على أبويه وأجداده وجدته إذا كانوا فقراء وإن خالفوه في دينه أما الأبوان فلقوله تعالى { وصاحبهما في الدنيا معروفا } نزلت الآية في الأبوين الكافرين وليس من المعروف أن يعيش في نعم الله تعالى ويتركهما يموتان جوعا وأما الأجداد والجدات فلأنهم من الآباء والأمهات ولهذا يقوم الجد مقام الأب عند عدمه ولأنهم سببوا لإحياءه فاستوجبوا عليه الإحياء بمنزلة الأبوين وشرط الفقر لأنه لو كان ذا مال فإيجاب نفقته في ماله أولى من إيجابها في مال غيره ولا يمنع ذلك باختلاف الدين لما تلونا (هداية 2/445-446)
