Q: There is a soccer tournament taking place in a neighbouring town, and up to 8 teams are invited to participate. Each team has to pay an ‘affiliation/entry’ fee of R2800 in order to participate. The winning team receives prize money of R4500. The team that comes out 2nd receives R2000. The rest of the teams do not receive any money. Apart from all the other contentious issues (such as the covering of the satr, intermingling of genders etc), is the way in which this event is structured permissible?
A: It is not permissible. Apart from the other wrongs associated with this type of event, it is not permissible to participate in the competition as the element of gambling is found.

إنما يجوز ذلك إن كان البدل معلوما في جانب واحد بأن قال إن سبقتني فلك كذا وإن سبقتك لا شيء لي عليك أو على القلب أما إذا كان البدل من الجانبين فهو قمار حرام الخ (الفتاوى الهندية 5/324)
( حل الجعل ) … ( إن شرط لمال ) في المسابقة ( من جانب واحد وحرم لو شرط ) فيها ( من الجانبين ) لأنه يصير قمارا الخ
و في رد المحتار : قوله ( لأنه يصير قمارا ) لأن القمار من القمر الذي يزداد تارة وينقص أخرى وسمي القمار قمارا لأن كل واحد من المقامرين ممن يجوز أن يذهب ماله إلى صاحبه ويجوز أن يستفيد مال صاحبه وهو حرام بالنص ولا كذلك إذا شرط من جانب واحد لأن الزيادة والنقصان لا تمكن فيهما بل في أحدهما تمكن الزيادة وفي الآخر الانتقاص فقط فلا تكون مقامرة لأنها مفاعلة منه زيلعي (رد المحتار 6/402)
