Delaying Esha Salaah

Q: Can you please tell me if our Esha Salaah gets late, could it be read after midnight? Because after midnight a new day commences? Please can you help me?

Bismillaah

A: It is makrooh to delay the Esha Salaah till after half the night. However the Esha Salaah will be valid. The time of Esha remains till the time of fajr (i.e. Subah Saadiq). Once the time of fajr sets in, the Esha Salaah will become qadha.

And Allah Ta’ala (الله تعالى) knows best.

قوله ( والعشاء إلى الثلث ) أي ندب تأخيرها إلى ثلث الليل لما رواه الترمذي وصححه لولا أن أشق على أمتي لأخرت العشاء إلى ثلث الليل أو نصفه وفي مختصر القدوري إلى ما قبل الثلث لرواية البخاري كانوا يصلون العتمة فيما بين أن يغيب الشفق إلى ثلث الليل ومقتضاه أنه لا يستحب تأخيرها إلى الثلث بخلاف الأول ووفق بينهما في شرح المجمع لابن الملك بحمل الأول على الشتاء والثاني على الصيف لغلبة النوم ا ه وأطلقه فشمل الصيف والشتاء وقيل يستحب تعجيل العشاء في الصيف لئلا تتقلل الجماعة وأفاد أن التأخير إلى نصف الليل ليس بمستحب وقالوا إنه مباح وإلى ما بعده مكروه (البحر الرائق 1/ 260)
