Taking an oath that if one does a certain action, one will die as a kaafir

Q: If a person swears to Allah that he will never to do a particular act and if he does it he will die a kafir.If he breaks his oath will he die as a kafir?

Bismillaah

A: Taking such an oath is impermissible. He should sincerely repent for taking such an oath and refrain from this in the future. He should discharge the kaffara for breaking the oath.

And Allah Ta’ala (الله تعالى) knows best.

( و ) القسم أيضا بقوله ( إن فعل كذا فهو ) يهودي أو نصراني أو فاشهدوا علي بالنصرانية أو شريك للكفار أو ( كافر ) فيكفر بحنثه (الدر المختار 3/ 717-718)

قال الشامي : قوله ( فيكفر بحنثه ) أي تلزمه الكفارة إذا حنث إلحاقا له بتحريم الحلال لأنه لما جعل الشرط علما على الكفر وقد اعتقده واجب الامتناع وأمكن القول بوجوبه لغيره جعلناه يمينا نهر (رد المحتار 3/ 718)
