Changing one’s intention during safar

Q: A person travels to a place that is safar distance and intends staying there for 10 days. After 8 days the person changes his intention and intends staying for another 8 days. Will the person read full namaaz or will he be a musaafir? What about the salaah that was performed in the first 8 days? Will he have to repeat the Salaah?

A: He will be a musaafir and he will not have to repeat the Salaah performed in the first eight days.

And Allah Ta’ala (الله تعالى) knows best.

(فيقصر إن نوى) الإقامة (في أقل منه) أي في نصف شهر (أو) نوى (فيه لكن في غير صالح) أو كنحو جزيرة أو نوى فيه لكن (بموضعين مستقلين كمكة ومنى) فلو دخل الحاج مكة أيام العشر لم تصح نيته لأنه يخرج إلى منى وعرفة فصار كنية الإقامة في غير موضعها وبعد عوده من منى تصح كما لو نوى مبيته بأحدهما أو كان أحدهما تبعا للآخر بحيث تجب الجمعة على ساكنه للاتحاد حكما (أو لم يكن مستقلا برأيه) كعبد وامرأة (أو دخل بلدة ولم ينوها) أي مدة الإقامة (الدر المختار 2/126)

والحاصل أن شروط الإتمام ستة: النية، والمدة، واستقلال الرأي، وترك السير، واتحاد الموضع، وصلاحيته، قهستاني. (الدر المختار 2/128)
