Annulling the nikaah

Q: My wife and I never been intimate for 8 months and she applied for annulment. Is our marriage or nikaah canceled? I never give her talaaq yet. Please advise. We don’t live together but we still talk.

A: If the nikaah has not been annulled through the Shari’ee procedures of annulment and nor did you give your wife talaaq, then the nikaah still remains. 

And Allah Ta’ala (الله تعالى) knows best.
