Iddat period of talaaq

Q: I am 47 years old and married for 19 years. This is my third marriage (I am the only wife). I was married twice in my twenty’s and got fasagh for both (valid reasons). The problem is at that stage of my life I had no guidance from anyone. I have a father and a brother but they never explained to me right and wrong, the only Islamic thing my father spoke to me about was to wear a scarf and I thought that makes you a Muslim. My mother is a revert and my father and brother also never guided her. I never made ibadah, never knew much about the deen as my father also didn’t live and practise deen. Now I am coming back to my actual dilemma. Alhamdulillah I have transformed tremendously since I married my current husband of 19 years and he has been my guide my anchor. I am really living and fulfilling my Deen. There was a topic the other day about iddah and the explanation about the punishment of not observing idaah properly. Therefore I need advise. For both marriages I never observed iddah because of ignorance, no one explained it and maybe they did and I didn’t understand. I now want to make things right but I need guidance. Please give me advise on this matter.

A: The iddat period of talaaq is three haidh. If a women did not observe the iddat in the prescribed manner, however the iddat period passed, then she will come out of iddat. She should seek forgiveness from Allah Ta’ala for not observing the iddat in the correct manner. If during the iddat period a woman remarried, the nikaah will be invalid.

And Allah Ta’ala (الله تعالى) knows best.

وَالْمُطَلَّقَاتُ يَتَرَبَّصْنَ بِأَنفُسِهِنَّ ثَلَاثَةَ قُرُوءٍ ﴿البقرة: ٢٢٨﴾

إذا وجبت العدة بالشهور في الطلاق والوفاة فإن اتفق ذلك في غرة الشهر اعتبرت الشهور بالأهلة وإن نقص العدد عن ثلاثين يوما وإن اتفق ذلك في خلاله فعند أبي حنيفة رحمه الله تعالى وإحدى الروايتين عن أبي يوسف رحمه الله تعالى يعتبر في ذلك عدد الأيام تسعون يوما في الطلاق وفي الوفاة يعتبر مائة وثلاثون يوما كذا في المحيط (الفتاوى الهندية 1/527)

( وهي في ) حق ( حرة ) ولو كتابية تحت مسلم ( تحيض لطلاق ) ولو رجعيا ( ثلاث حيض كوامل ) لعدم تجزي الحيضة فالأولى لتعرف براءة الرحم والثانية لحرمة النكاح والثالثة لفضيلة الحرية (رد المحتار 3/ 504)

( ومبدأ العدة بعد الطلاق و ) بعد ( الموت ) على الفور ( وتنقضي العدة وإن جهلت ) المرأة ( بهما ) أي بالطلاق والموت لأنها أجل فلا يشترط العلم بمضيه سواء اعترف بالطلاق أو أنكر

قال الشامي في رد المحتار : قوله ( لأنها أجل ) أي لأن العدة أجل فلا يشترط العلم بمضيه أي بمضي الأجل اه ح وفي عامة النسخ لأنهما بضمير التثنية أي عدة الطلاق وعدة الموت قلت وهذا مبني على تعريف البدائع من أن العدة أجل ضرب لانقضاء ما بقي من آثار النكاح وقدمنا ترجيحه (رد المحتار 3/ 520)

أما نكاح منكوحة الغير ومعتدته فالدخول فيه لا يوجب العدة إن علم أنها للغير لأنه لم يقل أحد بجوازه فلم ينعقد أصلا فعلى هذا يفرق بين فاسده وباطله في العدة ولهذا يجب الحد مع العلم بالحرمة لكونها زنا كما في القنية وغيرها اه (رد المحتار 3/ 516)

لا يجوز للرجل أن يتزوج زوجة غيره وكذلك المعتدة كذا في السراج الوهاج سواء كانت العدة عن طلاق أو وفاة أو دخول في نكاح فاسد أو شبهة نكاح كذا في البدائع (الفتاوى الهندية 1/ 280)
