Seller passes away in the process of a sale

Q: An offer of purchase is signed by the purchaser and accepted by way of signing. The lawyers are busy with the sale and waiting for the monies.
Then the seller dies. Must his heirs honour that sale?

A: Yes. His heirs must honour the sale.

And Allah Ta’ala (الله تعالى) knows best.

وإذا حصل الإيجاب والقبول لزم البيع ولا خيار لواحد منهما إلا من عيب أو عدم رؤية (هداية 3/20)
