Wudu with Disability: Can Mustamal Water be Used for Washing Feet?

Q: 

  1. A person who has disability is unable to raise the feet up to the sink basin for wudhu so she gets a bucket of water, takes water from the bucket puts water on the right foot with the hand and the mustamal (used) water falls in the same bucket which has clean water, then she uses the same water for the left foot, the question is if musta’mal and clean water mixes together can it be used for washing the left foot?
  2. In the above situation is the wudhu valid?
  3. If the wudhu was not valid does the salah have to be repeated, which was prayed with the washing of the feet with mustamal (used) water and clean water mixed together?

A: 

  1. If the musta’mal water was lesser in quantity than the unused water, the wudhu will be valid.
  2. As above.
  3. As above.

فلو مباينا لأوصافه فبتغير أكثرها أو موافقا كلبن فبأحدها أو ممثالا كمستعمل فبالأجزاء فإن المطلق أكثر من النصف جاز التطهير بالكل وإلا لا

قال الشامي : قوله ( بتغير أكثرها ) أي فالغلبة بتغير أكثرها وهو وصفان فلا يضر ظهور وصف واحد في الماء من أوصاف الخل مثلا قوله ( كلبن ) فإنه موافق للماء في عدم الرائحة مباين له في الطعم واللون وكماء البطيخ أي بعض أنواعه فإنه موافق له في عدم اللون والرائحة مباين له في الطعم هذا وفي حاشية الرملي على البحر أن المشاهد في اللبن مخالفته للماء في الرائحة قوله ( فبأحدها ) أي فغلبته بتغير أحد الأوصاف المذكورة كالطعم أو اللون في اللبن وكالطعم فقط في البطيخ فافهم قوله ( كمستعمل ) أي على القول بطهارته وكالماء الذي يؤخذ بالتقطير من لسان الثور وماء الورد المنقطع الرائحة بحر قوله ( وإلا لا ) أي وإن لم يكن المطلق أكثر بأن كان أقل أو مساويا لا يجوز قوله ( وهذا ) أي ما ذكر من اعتبار الأجزاء في المستعمل يعم الملقى بالبناء للمفعول أي ما كان مستعملا من خارج ثم أخذ وألقي في الماء المطلق وخلط به والملاقي أي والذي لاقى العضو من الماء المطلق القليل بأن انغمس فيه محدث أو أدخل يده فيه (رد المحتار 1/ 182)
