Husband promising to give divorce

Q: One day I asked my husband that if you abuse me again then promise me that you will give me divorce. He said ok and after 2 minutes at the same moment he said ok means I won’t abuse you but I can’t promise to divorce you. Few days ago he abused me so does divorce take place?

A: No. Divorce does not take place.

And Allah Ta’ala (الله تعالى) knows best.

الطلاق على ضربين صريح وكناية فالصريح قوله أنت طالق ومطلقة وطلقتك فهذا يقع به الطلاق الرجعي … ولا يفتقر إلى النية (الهداية 2/359)

وأما الضرب الثاني وهو الكنايات لا يقع بها الطلاق إلا بالنية أو بدلالة الحاللأنها غير موضوعة للطلاق بل تحتمله وغيره فلا بد من التعيين أو دلالته (الهداية 2/373)
