Can a Husband Reclaim His Wife After Two Talaaqs?

Q: If a husband pronounces two talaaqs to his wife and then he did not make ruju in one year with the wife than what will be the implementation of talaaq? Can he take his wife back after one year and make ruju? Or do they have to do halala. What can he do?

A: If the husband only issued two talaaqs and the husband and wife wish to reconcile after the iddah, then it is permissible provided a new nikaah is performed with a new mahr.

And Allah Ta’ala (الله تعالى) knows best.

(وينكح ) مبانته بما دون الثلاث في العدة وبعدها بالإجماع ومنع غيره فيها لاشتباه النسب ( لا ) ينكح ( مطلقة ) من نكاح صحيح نافذ كما سنحققه ( بها ) أي بالثلاث ( لو حرة وثنتين لو أمة ) ولو قبل الدخول وما في المشكلات باطل أو مؤول كما مر ( حتى يطأها غيره ولو ) الغير ( مراهقا ) يجامع مثله وقدره شيخ الإسلام بعشر سنين (الدر المختار 3/409)
