Questions related to Qadha and Kaffaar for fasting

Q: Are the rules same for intentionally breaking a fast in Ramdhan, and not keeping a fast at all for no valid reason? Under what circumstances do we have to do kaffara and under what circumstances do we have to do just qadha? Does breaking a fast just because you were hungry or you felt you don’t want to fast anymore need qadha and kaffara or just qadha? Does not fasting at all need kaffara as well as qadha or just qadha?

A: 

  1. No.
  2. If one had not fasted, then only qadha will be compulsory. Conversely if one had broken the fast through eating, drinking or having relations, etc. then together with qadha kaffara will also be compulsory.
  3. Qadha and Kaffara.
  4. As mention in number 2. (For the details of the laws of Kaffara refer to Behishti Zewar)

باب ما يوجب القضاء والكفارة قال وإذا أكل الصائم أو شرب أو جامع نهارا ناسيا لم يفطر والقياس أن يفطر وهو قول مالك رحمه الله لوجود ما يضاد الصوم فصار كالكلام ناسيا في الصلاة ووجه الاستحسان قوله عليه الصلاة والسلام الذي أكل وشرب ناسيا تم على صومك فإنما أطعمك الله وسقاك وإذا ثبت هذا في الأكل والشرب ثبت في الوقاع للاستواء في الركنية بخلاف الصلاة لأن هيئة الصلاة مذكرة فلا يغلب النسيان ولا مذكر في الصوم فيغلب ولا فرق بين الفرض والنفل لأن النص لم يفصل ولو كان مخطئا أو مكرها فعليه القضاء خلافا للشافعي رحمه الله فإنه يعتبر بالناسي ولنا أنه لا يغلب وجوده وعذر النسيان غالب ولأن النسيان من قبل من له الحق والإكراه من قبل غيره فيفترقان كالمقيد والمريض في قضاء الصلاة (هداية 1/216)
