On-line Forex Trading

Q: I live in India and I am interested in Online forex trading of currencies i.e USD-INR or Euro-INR which involves margin trading & interest is not charged on the same. Brokrage/fees is charged by the bank for each lot. Is it permissible to trade or not?

A: The Shar’ee principle in regard to a business transactions is that in a situation where both exchanges are specific commodities (i.e. both have the potential of being مبيع), then in order for the transaction to be valid at least one exchange should be received at the time of the transaction (though the other item be deferred). However, if a specific commodity is being sold in exchange of an unspecific commodity (e.g. an item being sold in exchange of money) then in order for the transaction to be valid at least possession of the specific commodity should be taken. 

In the case of online forex, since both exchanges are deferred, this transaction is invalid and impermissible in Islam.

And Allah Ta’ala (الله تعالى) knows best.

قال ويجوز بيع الفلس بالفلسين بأعيانهما عند أبي حنيفة وأبي يوسف رحمهما الله وقال محمد لا يجوز لأن الثمنية تثبت باصطلاح الكل فلا تبطل باصطلاحهما وإذا بقيت أثمانا لا تتعين فصار كما إذا كانا بغير أعيانهما وكبيع الدرهم بالدرهمين ولهما أن الثمنية في حقهما تثبت باصطلاحهما إذ لا ولاية للغير عليهما فتبطل باصطلاحهما وإذا بطلت الثمنية تتعين بالتعيين ولا يعود وزنيا لبقاء الاصطلاح على العد إذ في نقضه في حق العد فساد العقد فصار كالجوزة بالجوزتين بخلاف النقود لأنها للثمنية خلقة وبخلاف ما إذا كانا بغير أعيانهما لأنه كالىء بالكالىء وقد نهى عنه وبخلاف ما إذا كان أحدهما بغير عينه لأن الجنس بانفراده يحرم النساء (هداية 3/81)
