Kissing one’s wife while fasting

Q: Regarding kissing the wife during Ramadhan fast. I knew that it was permissibile to kiss the wife as long as it does not lead to anything further. Only recently did I become aware that only kissing without the tongue was meant as kissing with the tongue would require qadha and kafaarah due to the exchange of saliva. As kissing with the tongue is the norm I had not made that distinction till now. Am I required to perfrom qadha and kafaarah or just qadha due to misunderstanding as I see in nurul idha that kafaarah will not be required if someone misunderstood the hadith?

A: If through kissing the saliva of the wife was swallowed, then qadha and kaffara will be compulsory.

And Allah Ta’ala (الله تعالى) knows best.

( وإن جامع ) المكلف آدميا مشتهى ( في رمضان أداء ) لما مر ( أو جومع ) أو توارث الحشفة ( في أحد السبيلين ) أنزل أو لا ( أو أكل أو شرب غذاء ) بكسر الغين والذال المعجمتين والمد ما يتغذى به ( أو دواء ) ما يتداوى به والضابط وصول ما فيه صلاح بدنه لجوفه ومنه ريق حبيبه فيكفر لوجود معنى صلاح البدن فيه (الدر المختار 2/ 409- 410 )

ولو ابتلع بزاق غيره فسد صومه بغير كفارة إلا إذا كان بزاق صديقه فحينئذ تلزمه الكفارة كذا في المحيط (الفتاوى الهندية 1/ 203)
