Can a Woman Prohibit Her Husband from Taking Another Wife?

Q: Is it permissible for a woman to stipulate before marriage that the husband cannot take another wife for a certain amount of years? If the husband does take another wife, does it nullify the nikkah?

A: Such a condition is invalid in Shari’ah. Hence if the husband marries another woman, his nikaah with his previous wife will not be nullified.

And Allah Ta’ala (الله تعالى) knows best.

حدثنا كثير بن عبد الله بن عمرو بن عوف المزني عن أبيه عن جده : أن رسول الله صلى الله عليه و سلم قال الصلح جائز بين المسلمين إلا صلحا حرم حلالا أو أحل حراما والمسلمون على شروطهم إلا شرطا حرم حلالا أو حل حراما قال أبو عيسى هذا حديث حسن صحيح (ترمذي #1352)
