Where should a woman spend her iddah?

Q: If a woman is given a talaq, is it permissible for her to agree with husband that she spends her iddah at her parents’ home instead of the husband’s home, because of the enmity that exists between them (her and the husband)?

A: The divorced wife should spend the iddat in the house of the husband. If the talaaq issued was a revocable talaaq, then the husband has the right to revoke the talaaq as long as the wife is in iddat. If the talaaq issued was an irrevocable talaaq, then the iddat will be spent in the house of the husband in such a way that there is complete separation between her and her husband. However, if she cannot manage to spend the iddat at the husbands place due to fear or enmity, she can spend her iddat at her parents place.

وعلى المعتدة أن تعتد في المنزل الذي يضاف إليها بالسكنى حال وقوع الفرقة والموت لقوله تعالى { لا تخرجوهن من بيوتهن } والبيت المضاف إليها هو البيت الذي تسكنه ولهذا لو زارت أهلها وطلقها زوجها كان عليها أن تعود إلى منزلها فتعتد فيه وقال عليه الصلاة والسلام للتي قتل زوجها اسكني في بيتك حتى يبلغ الكتاب أجله وإن كان نصيبها من دار الميت لا يكفيها فأخرجها الورثة من نصيبهم انتقلت لأن هذا انتقال بعذر والعبادات تؤثر فيها الأعذار فصار كما إذا خافت على متاعها أو خافت سقوط المنزل أو كانت فيها بأجر ولا تجد ما تؤديه ثم إن وقعت الفرقة بطلاق بائن أو ثلاث لا بد من سترة بينهما ثم لا بأس به لأنه معترف بالحرمة إلا أن يكون فاسقا يخاف عليها منه فحينئذ تخرج لأنه عذر ولا تخرج عما انتقلت إليه والأولى أن يخرج هو ويتركها وإن جعلا بينهما امرأة ثقة تقدر على الحيلولة فحسن وإن ضاق عليهما المنزل فلتخرج والأولى خروجه (هداية 2/429)
