Spending the night with another wife in the absence of the wife who’s turn it is

Q: Can a man spend the night with his other wife if the wife who’s turn it is, is not there even though she did not give him permission to spend the night with his other wife?

A: A man should be just towards both his wives. However if the wife whose turn it is, is not present (e.g. she is gone out on safr with her parents) then since she is not present, it will be permissible for the husband to spend that time with the other wife.

And Allah Ta’ala (الله تعالى) knows best.

( ولو أقام عند واحدة شهرا في غير سفر ثم خاصمته الأخرى ) في ذلك ( يؤمر بالعدل بينهما في المستقبل وهدر ما مضى وإن أثم به ) لأن القسمة تكون بعد الطلب … ( والبكر والثيب والجديدة والقديمة والمسلمة والكتابية سواء ) لإطلاق الآية (الدر المختار 3/205)
