Khula’ in lieu of the mahr amount

Q: Due to marriage problems, I left my husbands home and returned to my parents home. I repeatedly asked my husband for a khula’ because he refused to give me a talaaq. After a month I returned for a trial period. I was not happy at the end of the trial period and I went back to my parents home. On the day that I left, my husbands uncle told my husband that she is not happy in your marriage and she wants a talaaq and that she wants to give her mehar for khula. So my husbands uncle asked my husband in the presence of all of us that if his willing to take the mehar and give me a talaaq? My husband said that he accepts but he will give the answer the following week to our family Aalim. The following week my husband phoned our family Aalim to say that he is not willing to give me a talaaq. By my husband saying that he accpets, did the
khula’ go through?

I got an annulment from an Aalim in my city and I was sitting for iddat, (the annulment did not go through because the Aalim gave me an annulment without consulting my husband). I sent the annulment letter and my mehar to my husband without the intention of khula, and my husband accepted my mehar. Is my nikkah still valid?

A: If your husband accepted the khula’ in lieu of the mahr amount, the divorce is valid. 

And Allah Ta’ala (الله تعالى) knows best.

باب الخلع وإذا تشاق الزوجان وخافا أن لا يقيما حدود الله فلا بأس بأن تفتدي نفسها منه بمال يخلعها به لقوله تعالى { فلا جناح عليهما فيما افتدت به } فإذا فعلا ذلك وقع بالخلع تطليقة بائنة ولزمها المال لقوله عليه الصلاة والسلام الخلع تطليقة بائنة ولأنه يحتمل الطلاق حتى صار من الكنايات والواقع بالكنايات بائن إلا أن ذكر المال أغنى عن النية هنا ولأنها لا تسلم المال إلا لتسلم لها نفسها وذلك بالبينونة وإن كان النشوز من قبله يكره له أن يأخذ منها عوضا لقوله تعالى { وإن أردتم استبدال زوج مكان زوج } إلى أن قال { فلا تأخذوا منه شيئا } ولأنه أوحشها بالاستبدال فلا يزيد في وحشتها بأخذ المال وإن كان النشوز منها كرهنا له أن يأخذ منها أكثر مما أعطاها وفي رواية الجامع الصغير طاب الفضل أيضا لإطلاق ما تلونا بدءا ووجه الأخرى قوله عليه الصلاة والسلام في امرأة ثابت بن قيس بن شماس أما الزيادة فلا وقد كان النشوز منها ولو أخذ الزيادة جاز في القضاء وكذلك إذا أخذ والنشوز منه لأن مقتضى ما تلوناه شيآن الجواز حكما والإباحة وقد ترك العمل في حق الإباحة لمعارض فبقي معمولا في الباقي وإن طلقها على مال فقبلت وقع الطلاق ولزمها المال لأن الزوج يستبد بالطلاق تنجيزا وتعليقا وقد علقه بقبولها والمرأة تملك التزام المال لولايتها على نفسها وملك النكاح مما يجوز الاعتياض عنه وإن لم يكن مالا كالقصاص وكان الطلاق بائنا لما بينا ولأنه معاوضة المال بالنفس وقد ملك الزوج أحد البدلين فتملك هي الآخر وهو النفس تحقيقا للمساواة (هداية 2/404)
