Who is responsible for the division of the estate

Q: My father died leaving behind my mother, 5 daughters, 2 brothers, 2 sisters. According to sharia after deducting the burial expenses, debts and one third of the estate for bequests, the estate will be divided into 720 shares and will be distributed as follows: The wife will receive 90 shares, each daughter will receive 96 shares, each brother will receive 50 shares, and each sister will receive 25 shares.

One of the sisters died after my father’s death.

One of my uncle (father’s brother) and one sister denied taking any share.

Children of one sister who died after my father’s death are also denying taking their mother’s share.

  1. What should be done?
  2. Who is responsible for the division of my fathers estate?

A: 

  1. The deceased brother and sister who do not want their share should accept their share and thereafter gift it to whomever they wish.
  2. The Wali of the deceased will be responsible for winding and distributing the estate. If the father of the deceased is not alive, then the son of the deceased will be the wali.

( ثم الولي ) بترتيب عصوبة الإنكاح إلا الأب فيقدم على الابن اتفاقا إلا أن يكون عالما والأب جاهلا فالابن أولى فإن لم يكن له ولي فالزوج ثم الجيران ومولى العبد أولى من ابنه الحر لبقاء ملكه والفتوى على بطلان الوصية بغسله والصلاة عليه ( وله ) أي للولي ومثله كل من يقدم عليه من باب أولى ( الإذن لغيره فيها ) لأنه حقه فيملك إبطاله ( إلا ) أنه ( إن كان هناك من يساويه فله ) أي لذلك المساوي ولو أصغر سنا ( المنع ) لمشاركته في الحق أما البعيد فليس له المنع ( فإن صلى غيره ) أي الولي ( ممن ليس له حق التقدم ) على الولي ( ولم يتابعه ) الولي ( أعاد الولي ) ولو على قبره إن شاء لأجل حقه لا لإسقاط الفرض ولذا قلنا ليس لمن صلى عليها أن يعيد مع الولي لأن تكرارها غير مشروع ( وإلا ) أي وإن صلى من له حق التقدم كقاض أو نائبه أو إمام الحي أو من ليس له حق التقدم وتابعه الولي ( لا ) يعيد لأنهم أولى بالصلاة منه (الدر المختار 2/219)

Q: 

  1. My father has no son and my grand father is not alive. Then who will do the distribution of the estate.
  2. Children(4 sons and 5 daughters) of one of the sister (who died after my father’s death) are also denying to receive their mother’s share from my father’s estate. what can be done here?

A: 

  1. If the heirs are able to amicably wind and distribute the estate by themselves without any bickering, then they should do so.  However, if this is difficult, then they should refer to an Islamic Body (Jamiatul Ulama’ of the area) and ask them to wind and distribute the estate among the heirs.
  2. They should accept their share and thereafter gift it to whomsoever they wish.
