“If you want to leave, pack your things and go”

Q: A husband and wife have been having numerous arguments. During the course of these arguments, the husband has, on many occasions, told the wife “ if you want to leave, pack your things and go”. Does this nullify the nikah?

A: If the husband had intended divorce then talaaq baain will be effective.

الطلاق على ضربين صريح وكناية فالصريح قوله أنت طالق ومطلقة وطلقتك فهذا يقع به الطلاق الرجعي … ولا يفتقر إلى النية (الهداية 2/359)

وأما الضرب الثاني وهو الكنايات لا يقع بها الطلاق إلا بالنية أو بدلالة الحال (الهداية 2/373)
