Some questions relating to maut and ghusal

Q:  

  1. Is it permissible to let the non muslim to visit the one close to death or after his death?
  2. Is the law of those who is in janabat similar to the non muslim in approaching the mayyit before and after his death?
  3. Is it sunnat muakkada to make the whole body face the qibla in the qabr?
  4. Is it mustahab to use gloves while washing the body (besides the private parts)?
  5. Which parts of the woman’s body the itr is applied?
  6. Is it the hunoot that is put on the sajdah places of the mayyit?

A:

  1. A non muslim should not be present at the time the person passing away is in the throes of death (sakaraat) or after his death.
  2. Yes. 
  3. Yes.
  4. No. However if the mayyit has some contagious disease, then gloves can be used.
  5. The same law that applies to men applies to women in regard to applying itr i.e. itr will be applied on those limbs that are placed on the ground at the time of sajdah.
  6. Yes.

ويخرج من عنده الحائض والنفساء والجنب (الدر المختار 2 /193) 

ويدخل الميت مما يلي القبلة وذلك أن يوضع في جانب القبلة من القبر  (الفتاوى الهندية 1 /166)

تنبيه لم يذكر الاستنجاء للاختلاف فيه فعندهما يستنجي وعند أبي يوسف لا وصورته أن يلف الغاسل على يديه خرقة ويغسل السوأة لأن مسها حرام كالنظر جوهرة (رد المحتار 2/ 196)

(ويجعل الحنوط ) وهو بفتح الحاء ( العطر المركب من الأشياء الطيبة غير زعفران و ورس ) لكراهتهما للرجال وجعلهما في الكفن جهل ( على رأسه ولحيته ) ندبا ( والكافور على مساجده ) كرامة لها (الدر المختار 2 /197)

ثم يوضع الحنوط على رأْسه ولحيته لما روي أَنّ آدم صلى اللَّهِ عليه وسلم عليه لمّا توفي غسلته الملائكة وحنطوه ويوضع الكافور على مساجده يعني جبهته وأنفه ويديه وركبتيه وقدميه لما روي عن ابن مسعود رضي الله عنه أنّه قال وتتبع مساجده بالطيب يعني بالكافور … ولا بأس بسائر الطيب غير الزعفران والورس في حق الرجل (بدائع الصنائع 2 /40)

(قوله ويجعل الحنوط في لحيته ورأسه وسائر جسده ) وإن لم يكن حنوط لا يضره ولا بأس بسائر الطيب غير الزعفران والورس فإنه لا يقربه الرجال كما في الحياة ويجعل المسك والعنبر في الحنوط وقال طاوس وعطاء لا يطيب الرجل بالمسك ولا بأس أن يحنط النساء بالزعفران اعتبارا بحال الحياة .

( قوله والكافور على مساجده ) يعني جبهته وأنفه وكفَيه وركبتيه وقدميه لفضيلتها لأنَه كان يسجد بها للّه تعالى فاختصت بزيادة الكرامة والرجل والمرأة في ذلك سواء. (الجوهرة النيرة 1/134)
