Marrying the daughter of a woman one touched with lust

Q: A person has been married since 16 years and has three daughters( 14, 12, 7 yrs) and a son (3yrs). One or two year before marriage his mother in law was intimating him after that they( he and his mother in law) had sexual contact but not intercourse (dukhool). After the marriage they did not have that type of relation. Yesterday he heard from some source that her daughter was haram for him, so his marriage is not valid with her daughter. In that case children are also not halal with him and his wife. He loves his family very much. At the time of marriage he did not know her daughter will be haram for this action. He is very ashamed for his action since that time till now and asked forgiveness from Allah. Now he is very much worried about his wife and children. His wife did not know about that. We live here alone, where she will go. It will be very difficult for my daughters and son to survive with separated parents. My question is, his marriage is valid or not. If not what can he do to save six lives (any kuffara). May Allah reward you here and hereafter for helping his children, wife and himself. I will wait for your answer.

A: If a person touches a woman with lust (i.e directly without any veil in between), it will be impermissible for him to marry her mother and daughter. He should immediately separate from his wife with informing her that he no longer can live with her according to Shari’ah. The lineage of the children he has from that nikaah will be attributed to him and they will inherit from him. They will not be regarded as illegitimate children.    

And Allah Ta’ala (الله تعالى) knows best.

( قبل أم امرأته ) في أي موضع كان على الصحيح جوهرة ( حرمت ) عليه ( امرأته ما لم يظهر عدم الشهوة ) ولو على الفم كما فهمه في الذخيرة ( وفي المس لا ) تحرم ( ما لم تعلم الشهوة ) لأن الأصل في التقبيل الشهوة بخلاف المس ( والمعانقة كالتقبيل ) وكذا القرص والعض بشهوة ولو لأجنبية وتكفي الشهوة من أحدهما ومراهق ومجنون وسكران كبالغ بزازية وفي القنية قبل السكران بنته تحرم الأم وبحرمة المصاهرة لا يرتفع النكاح حتى لا يحل لها التزوج بآخر إلا بعد المتاركة وانقضاء العدة والوطء بها لا يكون زنا وفي الخانية إن النظر إلى فرج ابنته بشهوة يوجب حرمة امرأته وكذا لو فزعت فدخلت فراش أبيها عريانة فانتشر لها أبوها تحرم عليه أمها ( وبنت ) سنها ( دون تسع ليست بمشتهاة ) به يفتى (الدر المختار 3/37)

قوله ( وبحرمة المصاهرة الخ ) قال في الذخيرة ذكر محمد في نكاح الأصل أن النكاح لا يرتفع بحرمة المصاهرة والرضاع بل يفسد حتى لو وطئها الزوج قبل التفريق لا يجب عليه الحد اشتبه عليه أو لم يشتبه عليه اه قوله ( إلا بعد المتاركة ) أي وإن مضى عليها سنون كما في ( البزازية ) وعبارة الحاوي إلا بعد تفريق القاضي أو بعد المتاركة اه وقد علمت أن النكاح لا يرتفع بل يفسد وقد صرحوا في النكاح الفاسد بأن المتاركة لا تتحقق إلا بالقول إن كانت مدخولا بها كتركتك أو خليت سبيلك وأما غير المدخول بها فقيل تكون بالقول وبالترك على قصد عدم العود إليها وقيل لا تكون إلا بالقول فيهما حتى لو تركها ومضى على عدتها سنون لم يكن لها أن تتزوج بآخر فافهم قوله ( والوطء بها الخ ) أي الوطء الكائن في هذه الحرمة قبل التفريق والمتاركة لا يكون زنا قال في الحاوي والوطء فيها لا يكون زنا لأنه مختلف فيه وعليه مهر المثل بوطئها بعد والحرمة ولا حد عليه ويثبت النسب اه (رد المحتار 3/37)

 ومن مسته امرأة بشهوة حرمت عليه أمها وبنتها وقال الشافعي رحمه الله لا تحرم وعلى هذا الخلاف مسه امرأة بشهوة ونظره إلى فرجها ونظرها إلى ذكره عن شهوة (الهداية 2/309)

( ولا فرق ) فيما ذكر ( بين اللمس والنظر بشهوة بين عمد ونسيان ) وخطأ وإكراه فلو أيقظ زوجته أو أيقظته هي لجماعها فمست يده بنتها المشتهاة أو يدها ابنه حرمت الأم أبدا (الدر المختار)

قال الشامي: قوله ( أو يدها ابنه ) أي المراهق كما علم مما مر وأما تقييد الفتح بكونه ابنه من غيرها فقال في النهر ليعلم ما إذا كان ابنه منها بالأولى ولا بد من التقييد بالشهوة أو ازديادها في الموضعين (رد المحتار3/35)
