Is it Permissible to Sell Without Possession?

Q: 

  1. I remember hearing in a program that a person needs to take possession of an item before selling it. I sometimes get inquiries about my product from people living in other provinces. My supplier is prepared to make courier arrangements direct to the customer and add the courier costs to the price of the product. Although the customer receives the goods directly from My supplier, they do not know this as they pay me for the goods and courier and I pay the supplier in turn. So I actually do the sale without the goods coming to me. Is this permissible?
  2. Some items are costly and I do not keep any stock with me. Is it permissible for me to charge the customer and then order the goods?
  3. I am also the distributor for an item which is made in another province. I do not have a vehicle of my own to transport the goods and the space to store bulk orders. Is it permissible for me to take orders from customers and get the transport company to deliver directly to the customer?

A: 

  1. Since, the courier company is acting on behalf of yourself. The possession of the courier company is regarded as your possession (i.e. you are paying the courier company for transporting and delivering the goods.).
  2. It is impermissible in Shari’ah for one to sell an item before purchasing it except in the case of salam (Forward Buying). Salam refers to where the seller informs the purchaser that he does not posses the item but will charge him in advance in order to acquire the item for him in a period of a month or more. Transacting in Salam before one month is impermissible. Similarly there are certain conditions that apply for the validity of this type of transaction. The conditions are as follows:
    • The item from the time of the sale till the time it is acquired and delivered should be al least a month. 
    • The delivery date must be specified.
    • The item, goods should be from that type which it”s equivalent is available in the market e.g. cutlery, rice, food items, etc. If the item is of that type that does not have an exact equivalent e.g. live stock transacting salam in such items will be impermissible.
    • The complete description and details of the item should be given so as to avoid any future disputes and quarrels.
    • The price should be determined from the beginning and payment should take place of the goods immediatly.
    • The items ordered should be present in the market from the time of the transaction right up till the delivery date.
  3. Yes it is permissible, however if you are selling the goods then you can only sell the goods after you have purchased it and taken possession of it.

ومن اشترى شيئا مما ينقل ويحول لم يجز له بيعه حتى يقبضه لأنه عليه الصلاة والسلام نهى عن بيع مالم يقبض ولأن فيه غرر انفساخ العقد على اعتبار الهلاك (هداية 3/74)

( وشرطه ) أي شروط صحته التي كبر أو تمر ( و ) بيان ( نوع ) ( وصفة ) كجيد أو رديء ( وقدر ) ككذا كيلا لا ينقبض ولا ينبسط ( وأجل وأقله ) في السلم ( شهر ) به يفتى وفي الحاوي لا بأس بالسلم في نوع واحد على أن يكون حلول بعضه في وقت وبعضه في وقت آخر ( ويبطل ) الأجل ( بموت المسلم إليه لا بموت رب السلم فيؤخذ ) المسلم فيه ( من تركته حالا ) لبطلان الأجل بموت المديون لا الدائن ولذا شرط دوام وجوده لتدوم القدرة على تسليمه بموته ( و ) بيان ( قدر رأس المال ) إن تعلق العقد بمقداره كما ( في مكيل وموزون وعددي غير متفاوت ) واكتفيا بالإشارة كما في مذروع وحيوان قلنا ربما لا يقدر على تحصيل المسلم فيه فيحتاج إلى رد رأس المال ابن كمال وقد ينفق بعضه ثم يجد باقيه معيبا فيرده ولا يستبدله رب السلم في مجلس الرد فينفسخ العقد في المردود ويبقى في غيره فتلزم جهالة المسلم فيه فيما بقي ابن ملك فوجب بيانه ( و ) السابع بيان ( مكان الإيفاء ) للمسلم فيه ( فيما لو حمل ) أو مؤنة ومثله الثمن والأجرة والقسمة وعينا مكان العقدوبه قالت الثلاثة كبيع وقرض وإتلاف وغصب قلنا هذه واجبة التسليم في الحال بخلاف الأول ( شرط الإيفاء في مدينة فكل محلاتها سواء فيه ) أي في الإيفاء ( حتى لو أوفاه في محلة منها برىء ) وليس له أن يطالبه في محلة أخرى

 بزازية وفيها قبله شرط حمله إلى منزله بعد الإيفاء في المكان المشروط لم يصح لاجتماع الصفقتين الإجارة والتجارة ( وما لا حمل له كمسك وكافور وصغار لؤلؤ لا يشترط فيه بيان مكان الإيفاء ) اتفاقا ( ويوفيه حيث شاء ) في الأصح فتح لأنه يفيد سقوط خطر الطريق ( و ) بقي من الشروط ( قبض رأس المال ) ولو عينا ( قبل الافتراق ) بأبدانهما وإن ناما أو سارا فرسخا أو أكثر ولو دخل ليخرج الدراهم إن توارى عن المسلم إليه بطل وإن بحيث يراه لا وصحت الكفالة والحوالة والارتهان برأس مال السلم بزازية ( وهو شرط بقائه على الصحة لا شرط انقعاده بوصفها ) فينعقد صحيا ثم يبطل بالافتراق بلا قبض ( ولو أبى المسلم إليه قبض رأس المال أجبر عليه ) خلاصة وبقي من الشروط كون رأس المال منقودا وعدم الخيار وأن لا يشمل البدلين إحدى علتي الربا وهو القدر المتفق أو الجنس لأن حرمة النساء تتحقق به وعدها العيني تبعا للغاية سبعة عشر وزاد المصنف وغيره القدرة على تحصيل المسلم فيه (الدر المختار 5/214)
