Gargling the mouth and cleaning the nose while fasting

Q: 

  1. A person begins fasting in the state of janaabat. Regarding ghusl in this state, is the ghusl valid if the water does not reach the inside of the throat or the inside of the nose (i.e. these actions cannot be exaggerated out of fear of the fast breaking)? Will the ghusl be valid if the water did not reach deep into these areas? Or would the person make ghusl washing the nose and mouth as in wudhu and upon breaking the fast would the person then gargle the throat and wash the inside of the nose properly?
  2. A person forgets that they are fasting, and thus gargles and washes the nose intensely so that water is accidentally swallowed. Is the fast broken, bearing in mind that the person forgot that s/he was fasting?

A: 

  1. Gargling the mouth and rinsing the the nose is sufficient. Ensuring that the water reaches the upper portion of the nose  and the inner portion of the mouth is not necessary.
  2. If at the time one gargled the mouth and rinsed the nose, one did not remember that he was fasting, the fast will not break.

(وإن أفطر خطأ كأن تمضمض فسبقه الماء قال في الشامي: (قوله وإن أفطر خطأ) شرط جوابه قوله التي قضى فقط وهذا شروع في القسم الثاني وهو ما يوجب القضاء دون الكفارة … (قوله فسبقه الماء) أي يفسد صومه إن كان ذاكرا له (رد المحتار على در المختار ج2 ص401)

وإن تمضمض أو استنشق فدخل الماء جوفه إن كان ذاكرا لصومه فسد صومه وعليه القضاء (الفتاوى الهندية ج1 ص203)

عن عاصم بن لقيط بن صبرة عن أبيه : أنه أتى النبى -صلى الله عليه وسلم- فذكر أشياء ، فقال له النبى -صلى الله عليه وسلم- :« أسبغ الوضوء وخلل الأصابع ، وإذا استنشقت فبالغ إلا أن تكون صائما (السنن الكبرى للبيهقي #231)
