Lessor Must Agree to Bank’s Conditions for Loan Approval

Q: Suppose we have the following scenario, a person owns a business, and is the landlord at the same time. He decides to sell the business and lease out the commercial property to the same person. The bank is loaning the buyer the money to purchase the property. The bank requests that the seller of the business (who is also the landlord) signs a document with the following conditions: 

The conditions are that if the purchaser of the business defaults, then the bank has the right to take over the lease (in other words, they will continue to pay the landlord rent until they find someone to purchase the business off them). 

Does this arrangement constitute riba to the landlord / business seller? Without the signing of this document the buyer cannot loan money from the bank, so does this mean the seller is helping the buyer attain riba and is accountable for this?

A: If the loan the bank is providing is an interest bearing loan, it will be impermissible for the landlord to sign the documents as he will be aiding in sin.

وَتَعَاوَنُوا عَلَى الْبِرِّ وَالتَّقْوَىٰ وَلَا تَعَاوَنُوا عَلَى الْإِثْمِ وَالْعُدْوَانِ وَاتَّقُوا اللَّهَ إِنَّ اللَّهَ شَدِيدُ الْعِقَابِ ﴿المائدة: ٢﴾

الَّذِينَ يَأْكُلُونَ الرِّبَا لَا يَقُومُونَ إِلَّا كَمَا يَقُومُ الَّذِي يَتَخَبَّطُهُ الشَّيْطَانُ مِنَ الْمَسِّ ذَٰلِكَ بِأَنَّهُمْ قَالُوا إِنَّمَا الْبَيْعُ مِثْلُ الرِّبَا وَأَحَلَّ اللَّـهُ الْبَيْعَ وَحَرَّمَ الرِّبَا فَمَن جَاءَهُ مَوْعِظَةٌ مِّن رَّبِّهِ فَانتَهَىٰ فَلَهُ مَا سَلَفَ وَأَمْرُهُ إِلَى اللَّهِ وَمَنْ عَادَ فَأُولَئِكَ أَصْحَابُ النَّارِ هُمْ فِيهَا خَالِدُونَ ﴿البقرة: ٢٧٥﴾

يَا أَيُّهَا الَّذِينَ آمَنُوا إِنَّمَا الْخَمْرُ وَالْمَيْسِرُ وَالْأَنصَابُ وَالْأَزْلَامُ رِجْسٌ مِّنْ عَمَلِ الشَّيْطَانِ فَاجْتَنِبُوهُ لَعَلَّكُمْ تُفْلِحُونَ ﴿المائدة: ٩٠﴾

عن جابر رضي الله عنه قال لعن رسول الله صلى الله عليه وسلم آكل الربا وموكله وكاتبه وشاهديه وقال هم سواء رواه مسلم ( مشكوٰة المصابيح ص244)
