Requirements for the nikaah to be valid

Q: I am engaged 2 months ago. In our engagement ceremony both our and boy’s family and relatives were present. My father announced in front of all that I give my daughter (announced the name) to your son (announced the name) and all the people prayed and said congratulation to the boy and girl. Has the nikah taken place in this situation? Please answer my question because I am talking with my fiance on the phone so is it halal for me or not?

Bismillaah

A: In order for the nikaah to be valid, it is a requirement that an offer as well as an acceptance be found in the same gathering in the presence of at least two male baaligh sane muslims or one male and two female baaligh sane muslims. Since there was no acceptance from the boys side in the same gathering the nikaah is not valid. People praying and saying congratulations is not an acceptance. However if prior to the function the boy appointed your father to perform his nikaah with you and thereafter your father in the presence of the gathering said “I give my daughter to your son”, in this case the nikaah will be valid.

قال ولا ينعقد نكاح المسلمين إلا بحضور شاهدين حرين عاقلين بالغين مسلمين رجلين أو رجل وامرأتين عدولا كانوا أو غير عدول أو محدودين في القذف قال رضي الله عنه اعلم أن الشهادة شرط في باب النكاح لقوله عليه الصلاة والسلام لا نكاح إلا بشهود (هداية 2/306)

قال وتزويج العبد والأمة بغير إذن مولاهما موقوف فإن أجازه المولى جاز وإن رده بطل وكذلك لو زوج رجل امرأة بغير رضاها أو رجلا بغير رضاه وهذا عندنا فإن كل عقد صدر من الفضولي وله مجيز انعقد موقوفا على الإجازة وقال الشافعي رحمه الله تصرفات الفضولي كلها باطلة لأن العقد وضع لحكمه والفضولي لا يقدر على إثبات الحكم فيلغو ولنا أن ركن التصرف صدر من أهله مضافا إلى محله ولا ضرر في انعقاده فينعقد موقوفا حتى إذا رأى المصلحة فيه ينفذه وقد يتراخي حكم العقد عن العقد ومن قال اشهدوا أني قد تزوجت فلانة فبلغها الخبر فأجازت فهو باطل وإن قال آخر اشهدوا أني قد زوجتها منه فبلغها الخبر فأجازت جاز وكذلك إن كانت المرأة هي التي قالت جميع ذلك وهذا عند أبي حنيفة ومحمد رحمهما الله وقال أبو يوسف رحمه الله إذا زوجت نفسها غائبا فبلغه فأجازه جاز وحاصل هذا أن الواحد لا يصلح فضوليا من الجانبين أو فضوليا من جانب وأصيلا من جانب عندهما خلافا له ولو جرى العقد بين الفضوليين أو بين الفضولي والأصيل جاز بالإجماع هو يقول لو كان مأمورا من الجانبين ينفذ فإذا كان فضوليا بتوقف وصار كالخلع والطلاق والإعتاق على مال ولهما أن الموجود شطر العقد لأنه شطر حالة الحضرة فكذا عند الغيبة وشطر العقد لا يتوقف على ما وراء المجلس كما في البيع بخلاف المأمور من الجانبين فإنه ينتقل كلامه إلى العاقدين وما جرى بين الفضوليين عقد تام وكذا الخلع وأختاه لأنه تصرف يمين من جانبه حتى يلزم فيتم به (الهداية 1/323)
