A certain Masjid committee invested in the Oasis company on behalf of the Masjid

Q: A certain Masjid committee invested in the Oasis company on behalf of the Masjid. At that time they had not known that it was Haraam. By the time the committee discovered that it was Haraam the investment had already accrued 100 000 rands profit. The question now is that what should be done with the profits gained? A certain Aalim says that since the money belongs to the community, the trustees of the Masjid will have to take them into consideration when getting rid of the money. Another Aalim says that the money is Waqf. Therefore, the trustees will have the independent right of spending the money wherever it may be appropriate without consulting the public. Which of the 2 opinions are correct?

With regards to where the money should be spent, the first Aalim says that it could be spent to build some toilets for the Masjid, etc.. The second Aalim says that there certain people in the community who are heavily involved in debt. Among them 2 are deserving of Zakaat and the third although he is not deserving of Zakaat but he is having difficulty in paying the debt. Therefore, this money should be spent in paying off these peoples debts. Which opinion should be taken?

A: We are not fully aware of the workings of the Oasis fund. Hence, we are not in the position to say whether the profits accrued are halaal or haraam. If it can be proven that the profits accrued are halaal or a percentage thereof is halaal then the halaal wealth must be used for the benefit of the musjid and the portion that is clearly haraam must be  given out in charity without the niyyat of thawaab. 

قال ومن اشترى جارية بيعا فاسدا وتقابضا فباعها وربح فيها تصدق بالربح ويطيب للبائع ما ربح في الثمن والفرق أن الجارية مما يتعين فيتعلق العقد بها فيتمكن الخبث في الربح والدراهم والدنانير لا يتعينان في العقود فلم يتعلق العقد الثاني بعينها فلم يتمكن الخبث فلا يجب التصدق وهذا في الخبث الذي سببه فساد الملك أما الخبث لعدم الملك فعند أبي حنيفة رحمه الله ومحمد يشمل النوعين لتعلق العقد فيما يتعين حقيقة وفيما لا يتعين شبهة من حيث أنه يتعلق به سلامة المبيع أو تقدير الثمن وعند فساد الملك تنقلب الحقيقة شبهة والشبهة تنزل إلى شبهة الشبهة والشبهة هي المعتبرة دون النازل عنها (الهداية 3/66)

ولو كانت الكفالة بكر حنطة فقبضها الكفيل فباعهاوربح فيها فالربح له في الحكم لما بينا أنه ملكه قال وأحب إلي أن يرده على الذي قضاه الكر ولا يجب عليه في الحكم وهذا عند أبي حنيفة رحمه الله في رواية الجامع الصغير وقال أبو يوسف ومحمد رحمهما الله هو له ولا يرده على الذي قضاه وهو رواية عنه وعنه أنه يتصدق به لهما أنه ربح في ملكه على الوجه الذي بيناه فيسلم له وله أنه تمكن الخبث مع الملك إما لأنه بسبيل من الاسترداد بأن يقضيه بنفسه أو لأنه رضي به على اعتبار قضاء الكفيل فإذا قضاه بنفسه لم يكن راضيا به وهذا الخبث يعمل فيما يتعين فيكون سبيله التصدق في رواية ويرده عليه في رواية لأن الخبث لحقه وهذا أصح لكنه استحباب لا جبر لأن الحق له (الهداية 3/122)

فصل فيما يتغير بفعل الغاصب  قال وإذا تغيرت العين المغصوبة بفعل الغاصب حتى زال اسمها وعظم منافعها زال ملك المغصوب منه عنها وملكها الغاصب وضمنها ولا يحل له الانتفاع بها حتى يؤدي بدلها … وقوله ولا يحل له الانتفاع بها حتى يؤدي بدلها استحسان والقياس أن يكون له ذلك وهو قول الحسن وزفر رحمهما الله وهكذا عن أبي حنيفة رحمه الله رواه الفقيه أبو الليث رحمه الله وجهه ثبوت الملك المطلق للتصرف ألا ترى أنه لو وهبه أو باعه جاز وجه الاستحسان قوله عليه الصلاة والسلام في الشاة المذبوحة المصلية بغير رضا صاحبها أطعموها الأسارى أفاد الأمر بالتصدق زوال ملك المالك وحرمة الانتفاع للغاصب قبل الإرضاء ولأن في إباحة الانتفاع فتح باب الغصب فيحرم قبل الإرضاء حسما لمادة الفساد ونفاد بيعه وهبته مع الحرمة لقيام الملك كما في الملك الفاسد.
