Taking one’s wife back after issuing one Talaaq

Q: Although there was no real issue between me and my wife, her daughter had been a problem from day one. However to cut a long story short, My wife stated her reasons why she wanted a divorce and I reluctantly gave her 1 talak with the hope that we could reconcile. I did not want the divorce and still don’t. However, she proclaims the marriage is over and now im confused. Can you clarify the situation?

Bismillaah

A: If you had issued a revocable talaaq then it is permissible to take your wife back as long as she is in the iddat. If you had issued an irrevocable talaaq then it is permissible to take your wife back (with her consent) provided a new nikah is performed with a new mahr.

( هي استدامة الملك القائم ) بلا عوض ما دامت ( في العدة ) أي عدة الدخول حقيقة إذ لا رجعة في عدة الخلوة ابن كمال (الدر المختار 3/ 397)

قوله ( إن لم يطلق بائنا ) هذا بيان لشرط الرجعة ولها شروط خمس تعلم بالتأمل شرنبلالية قلت هي أن لا يكون الطلاق ثلاثا في الحرة أو اثنتين في الأمة ولا واحدة مقترنة بعوض مالي ولا بصفة تنبىء عن البينونة كطويلة أو شديدة ولا مشبهة كطلقة مثل الجبل ولا كناية يقع بها بائن ولا يخفى أن الشرط واحد هو كون الطلاق رجعيا (شامي 3/ 400)

وتصح مع إكراه وهزل ولعب وخطأ ( بنحو ) متعلق باستدامة ( راجعتك ورددتك ومسكتك ) بلا نية لأنه صريح ( و ) بالفعل مع الكراهة ( بكل ما يوجب حرمة المصاهرة ) كمس ولو منها اختلاسا أو نائما أو مكرها أو مجنونا أو معتوها (شامى 3/ 398)

(وينكح ) مبانته بما دون الثلاث في العدة وبعدها بالإجماع ومنع غيره فيها لاشتباه النسب ( لا ) ينكح ( مطلقة ) من نكاح صحيح نافذ كما سنحققه ( بها ) أي بالثلاث ( لو حرة وثنتين لو أمة ) ولو قبل الدخول وما في المشكلات باطل أو مؤول كما مر ( حتى يطأها غيره ولو ) الغير ( مراهقا ) يجامع مثله وقدره شيخ الإسلام بعشر سنين (الدر المختار 3/409)
