Talaaq Confusion: My Sister’s Divorce Dilemma

Answered as per Hanafi Fiqh by Muftionline.co.za

Q: My sister has been married to her husband for just over 15 years and they have 3 children, like most couples they been having there differences. A few months and her husband had a big argument and her husband moved out and applied for a talaaq and separated. The talaaq certificate was issued and was valid for 3 months. Before this period ends they can get back together in which her husband decided to get back and moved back in with her. A month later they had an argument and he moved out again and he sent a text I give you talaaq three times in which my sister turned up outside his place and said well why you texting, say it in my face. So he said it three times on her face. We believe and have been told by the imams that the talaq has happened. I have researched a lot and been reading a lot about talaaq and a lot of information is confusing. I read an article online explaining that a divorce has to be done in three months period where the husband has to be separated from his wife and give first talaaq, wait one month to think about it or to reconcile then the second next month and so on and after 3 months if he does not remember Allah (swt) and give final in which the husband is well aware of what he is doing and right state of mind but not spare of the moment in anger. My sister is also expecting. Can you please give me some insight into what is the true outcome to this.

Bismillaah

A: Since the husband has issued all the talaaqs, the nikaah has terminated. It is no longer permissible for them to live together.

And Allah Ta’ala (الله تعالى) knows best.
