Zakah management

Assalamu alaykum wa rahmatullahi wa barakatuhu.

I trust that Mufti Sahib is well.

Basically, we run a Zakaat organisation, and many people authorise us to discharge Zakaat on their behalf. We just wanted to clarify few issues, to ensure that we are discharging the Zakaat correctly.

Can Mufti Sahib kindly respond to the following queries:

1) If donors give our organisation advanced Zakah before their due date (like Zakah for 1437 AH), can we invest that money for now to cover our expenses, and distribute the money when the due date comes?

2) Do we have to give the exact same note which the person gave in Zakah, or can we use that money and give the value?

3) Do we have to have two seperate accounts in a bank for lillah and Zakah, or can we have one?

We would really appreciate Mufti Sahibs prompt response.

Answer

Wa’alaykum as Salam wa rahmatullahi wa barakatuhu,

1 Such money may only be invested with the consent and permission of the donors. If there is no clear permission from the donors, it will not be permissible to invest the funds. Bear in mind, should any loss occur in the investment, members of your organisation shall be held responsible and will be liable to replenish the loss the losses. (Fatawa Mahmudiyya, 14/171)

2. The best is to discharge the exact notes. However, if it is difficult to give the exact money, you may suffice by discharging the value.
Practically speaking, it is extremely difficult nowadays to give the exact note to the needy. Especially in a situation where most of the funds, whether Zakah or Lillah, are deposited by the payers into a banking account. The banks obviously do not keep these funds in separate ‘Zakah’ boxes or vaults.

The first exchange which takes place is when the Zakah payer makes a deposit into the bank account.

When the Zakah organisation withdraws the money, the bank will give notes which are are available at that branch/ATM (not the notes of the Zakah-payer). Then when the organisation transfers these notes for example to another country for distribution to the poor, they will deposit these notes into a banking account and ask for dollars to be transferred to the account in that foreign foreign country. When the bank’s instruction reaches the other bank, it pays out rupees for the dollars for example if the money is sent to Pakistan.

Thus, it has become impossible to give the exact notes. Although the exact notes should be given, this is no longer possible. Hence we apply the principle of Dhururah (real, dire need).

3. As a precautionary measure it is better to have two separate accounts. However, since the bank mixes the funds anyway, it is also permissible to have one account provided accurate records are kept. Your organization will have to make sure depositors indicate exact amounts of Lillah and Zakah. Then these amounts have to be entered in your ledgers for record purposes, management and distribution.

اليتيمة : سئل البقالي عمن أعطى رجلا دراهم ليتصدق بها عن زكاة الآمر فتصدق المأمور بدراهم نفسه هل تقع الزكاة عن الآمر ؟ فقال : إذا تصدق بذلك على نية الرجوع جاز ، وسئل عنها الوبري فقال : هذا على وجهين : إن كان صرف المال الذي دفعه الآمر في حاجته ، ثم دفعها من مال نفسه ، فهذا لا يجوز ، لأنه لما أنفقه صار مضمونا عليه فلا يبرأ إلا بالأداء إلى المالك ، وإن كان دفع الزكاة من مال نفسه ، وذلك القدر المدفوع إليه من الزكاة في يده ، فإنه يجزيه ويكون قصاصا استحسانا . (الفتاوى التاترخانية (3/227)

قلت: ومقتضاه أنه لو وجد العرف فلا ضمان لوجود الإذن حينئذ دلالة. والظاهر أنه لا بد من علم المالك بهذا العرف ليكون إذنا منه دلالة (قوله إذا وكله الفقراء) لأنه كلما قبض شيئا ملكوه وصار خالطا مالهم بعضه ببعض ووقع زكاة عن الدافع، لكن بشرط أن لا يبلغ المال الذي بيد الوكيل نصابا. فلو بلغه وعلم به الدافع لم يجزه إذا كان الآخذ وكيلا عن الفقير كما في البحر عن الظهيرية.
قلت: وهذا إذا كان الفقير واحدا، فلو كانوا متعددين لا بد أن يبلغ لكل واحد نصابا لأن ما في يد الوكيل مشترك بينهم، فإذا كانوا ثلاثة، وما في يد الوكيل بلغ نصابين لم يصيروا أغنياء فتجزي الزكاة عن الدفع بعده إلى أن يبلغ ثلاثة أنصباء إلا إذا كان وكيلا عن كل واحد بانفراده، فحينئذ يعتبر لكل واحد نصابه على حدة، وليس له الخلط بلا إذنهم؛ فلو خلط أجزأ عن الدافعين وضمن للموكلين. وأما إذا لم يكن الآخذ وكيلا عنهم فتجزي، وإن بلغ المقبوض نصبا كثيرة لأنهم لم يملكوا شيئا مما في يده. (حاشية ابن عابدين (2/ 269)

إذا دفع الرجلان إلى رجل كل واحد منهما دراهم ليتصدق به عن زكاة ماله فخلط الدراهم قبل الدفع ، ثم دفع فهو ضامن ، وفي الحجة : إلا إذا جحد الإذن ، أو أجاز المالكان فحينئذ يجوز ، وفي السراجية : أو وجدت دلالة الإذن بالخلط ، في اليتيمة : كما جرت العادة بالإذن من أرباب الحنطة بخلط ثمن الغلات . (الفتاوى التاترخانية (3/ 229)

قال محمد رحمه الله: في آخر كتاب الزكاة من «الأصل» فصل في بيان بيوت الأموال: يجب أن تكون بيت الأموال أربعة: أحدها: بيت مال الزكاة والعشور والكفارات إذا وصلت إلى يد الإمام. والثاني: بيت مال الخراج والجزية التي نقلت، وما يأخذه العاشر من الكفرة. والثالث: فصل في بيان بيوت الأموال: بيت مال الخمس يعني خمس الغنائم والمعادن والركاز والكنوز. والرابع: بيت مال اللقطات والتركات، وإنما وجب أن يكون بيوت المال أربعة أما بيت مال الزكاة والخراج والخمس؛ فلأن بكل مال منها حكم يختص به لا يشاركه مال آخر فيه، فمتى جعل الكل في بيت واحد، وخلطه لا يمكنه إقامة حكم كل مال .
