Sajdah Sahw behind the Imām: Various questions

Answered as per Hanafi Fiqh by Fatwaa.com

Assalamu ‘alaykum wa rahmatullahi wa barakatuhu Mufti Sahab,

In case sajdah sahw becomes necessary during a Salah in jama’ah due to Imam’s mistake, in the last qad’ah he recites the tashahhud, then gives one salam on the right side, then perform the two sajdatayn of sahw, and then returns in qad’ah, recites the tashahhud once again, durud Ibrahimi and du’a’, and gives the two salams.

1. Now, the congregation behind him, do they have to give the first salam just before the sajdah sahw, or should they remain silent? Or are both the two cases permissible and valid?

2. The problem is that if the congregation behind him didn’t expect that he was going to perform the sajdah-sahw, they may perform the first Salam thinking it’s the concluding salam (especially if they are hanafis and give the salam right after the imam’s first salam), or they may not perform it (especially if the are not Hanafis and would be waiting for the second salam), and then find the imam bowing down in sajdah for the sajda sahw. So, would be doing the opposite of what is the right action, invalidates their prayer? I.e.

2a. If the congregation too should give the single salam before the sajda, and one doesn’t give it due to not knowing it’s a single salam before sajda sahw, does this make his prayer void?

2b. If the congregation shouldn’t give the single salam before the sajda, and one does give it due to thinking it’s the final salam, does this makes his prayer void?

Or are both the cases permissible and valid (they can either give or not give the first salam before the sajdatayn) as long as the congregation perform the two sajdas and the final concluding salams with the Imam?

3. Would -due to now knowing it’s a salam before sajda sahw- having the wrong intention of one’s (muqtadi) salam being that ending one’s Salah, makes his Salah void, even if he then performs the two sajda sahw, and then the final salam?

Wassalam

Answer

Wa’alaykum as Salām wa rahmatullāhi wa barakātuhu,

1) The congregation behind will also make Salām with the Imām before the Sajdah Sahw,

2. a) It is fine if the congregation does not make Salām with the Imām, although it is better if they do.

2. b) That too is fine.

3) Even if one has the wrong intention, the prayer will still be valid.
