Reading Surah Fatiha twice

As salaamu alaykum,

What is the reason that if in the 1st or 2nd rakah Surah Fatiha is repeated twice (or the half of more) it does require Sajdah Sahw, but if it is repeated in the 3th or 4th rakah, it does not require Sajdah Sahw?

Answer

Wa’alaykum as Salam wa rahmatulahi wa barakatuhu,

The reason for this is that that in the first two rakats, immediately after Surah Fatiha, it is compulsory (wajib) to recite another Surah. By reciting Surah Fatiha again, the musalli is delaying this compulsory act.

However, in the second two rakats, since it is not wajib to recite a Surah after Surah Fatiha, he will not be delaying or ommitting a compulsory act by repeating Surah Fatiha. Hence there is no reason to make Sajda-e-Sahw compulsory. Likewise, Shariah has not specified any amount of Qiraa’ah for the second two rakaats. One can recite no Surah, Surah Fatiha once or more, or even Surah Fatiha and another Surah. Although the Sunnah is to recite only Surah Fatiha.

( ولو كرر الفاتحة في ركعة من الأوليين ) متواليا أو قرأ القرآن في ركوعه في سجوده أو في ) موضع ( التشهد يجب عليه ) سجود السهو للزوم تأخير الواجب وهو السورة في الصورة الأولى والقراءة في غير ما شرعت فيه في البواقي والتحرز عن ذلك واجب وإن قرأ الفاتحة ثم السورة الفاتحة لا يلزمه السهو وقيل يلزمه وكذا لو قرأ الفاتحة إلا حرفا ثم أعادها لا سهو عليه كذا في الخلاصة ( إن قرأ الفاتحة في ) إحدى الأخريين ( مرتين أو ضم فيهما ) إليها ( سورة ) أو قرأ السورة دون الفاتحة ( أو قرأ التشهد مرتين في ) القعدة ( الأخيرة أو تشهد قائما أو راكعا أو ساجدا لا سهو عليه ) كذا في المختار لعدم ترك واجب في ذلك كله لأن الفاتحة لم يتعين وحدها في الأخريين على سبيل الوجوب القيام والركوع والسجود محل الثناء والتشهد شاء وقيل إن تشهد في القيام بعد قراءة الفاتحة فعليه السهو وصححه السروجي وقيل لو تشهد في ركوعه أو سجوده يلزمه السهو (حلبي صغير (ص: 112)
