Performing Salāh with incorrect intention

Assala mualaikum

Omar prayed Maghrib Salaah (of that day) with the Intention of Qadha, assuming that the time of Maghrib Salaah had expired. He realised afterwards (after the time of Maghrib expired) in actual fact the time of Maghrib Salaah of that day had not expired.

1) Was his Maghrib salaah which he prayed with the Intention of Qadha valid?

2) Does he have to repeat the Maghrib Salaah which he prayed with the Intention of Qadha?

Could you please provide reference to answer. Jazakumullah u Khair

Answer

Muḥtaram Mawlānā Ṣāḥib,

Wa’alykum as Salām wa raḥmatullāhi wa barakātuhuh

1) The ṣalāh of ‘Umar will be valid. No consideration will be given to his incorrect intention.

2) He does not have to repeat the prayer.

ضابط فيما إذا عين وأخطأ

الخطأ فيما لا يشترط التعيين له لا يضر كتعيين مكان الصلاة وزمانها وعدد الركعات فلو عين عدد ركعات ثلاثا أو خمسا صح لأن التعيين ليس بشرط فالخطأ فيه لا يضره قال في النهاية ونية عدد الركعات والسجدات ليست بشرط ولو نوى الظهر ثلاثا وخمسا صحت وتلغو نية التعيين .

وكما إذا عين الإمام من يصلي به فبان غيره ومنه ما إذا عين الأداء فبان أن الوقت خرج أو القضاء فبان أنه باق وعلى هذا الشاهد إذا ذكر ما لا يحتاج إليه فالخطأ فيه لا يضره – الأشباه والنظائر لابن نجيم – 1 / 34

قوله ( فلا يضر الخطأ في عددها ) الظاهر أن الخطأ غير قيد
