How does a Masbooq Join Congregational prayer

Asalaamu alaikum,

1) Could you please inform me on how to join the Congregational prayer when late?

2) Sometimes when I am praying in jamaat, I dont have enough time to recite the thana and taawudh and tasmiya before the imam starts reciting fatiha. As soon as he starts reciting fatiha, should I stop and listen even if i have not completed the above. What about in a silent prayer

3) Is it permissible to make up prayers which you missed from when younger after the witr salaah?

4) When fasting, if ones mouth becomes dry and he rinses his mouth with water to moisten it, does this break his fast?

In the name of Allah, the Most Gracious, the Most Merciful.

Assalamualaikum Warahmatullahi Wabarakatuhu

1)

Hereunder is the procedure for a Masbooq (late comer) to complete his miss Rakaats.

  • In the Tashahud of the Imam’s fourth Rakaat , the Masbooq will recite the Attahiyyaat only.[1]
  • A Masbooq should only stand up to complete the miss Rakaats once the Imam has made the second Salaam.[2]
  • If a Masbooq missed two Rakaats he should recite the Sanaa, Ta’wuz, Bismillah, Surah Fatiha and a Surah in the first Rakaat and Bismillah, Surah Fatiha, and a Surah in the second Rakaat.[3]
  • If a Masbooq missed four Rakaats then in the last two Rakaats he should recite  Bismillah, Surah Fatiha only.[4]
  • Once the Masbooq performed his missed Rakaats, then he should sit down for the Tashahud and recite Attahiyaat, Durud Ibrahim and Dua and complete his Salaah by making two Salaams.

The recitation of the Imam is sufficient for you. You will not recite Surah Fatihah or any other Surah behind the Imam in any of the rak’aats you pray behind him.[5]

As for whether or not to recite the Thanaa[6] behind the Imam please refer to the following procedure;

  1. A Muqtadi (follower) started with the Imam, he will recite Thanaa in a loud prayer (Jahri) and silent prayer (Sirri).
  2. A Muqtadi joined in the first Rakaat in Qiyaam, he will not recite in loud prayer, hence he will recite Thanaa in the Silent prayer.
  3. A Muqtadi joined the Imam whilst he is in Ruku or first Sajda, the Muqtadi should recite the Thanaa in both the prayers (loud and silent prayers) if he thinks he would get the Imam in that position.
  4. A Muqtadi joined the Imam whilst he is in the Tashahud or second Sajda, the Muqtadi will not recite the Thanaa in both the prayers (loud and silent prayers).

As for the Ta’wwuz[7], and Tasmiyah[8], they will not be recited by the mudrik  (one did not miss any Rakaah behind the Imam) in either the silent or the loud prayers.

3)  Yes, It is permissible. Instead it is encouraged for a person to perform Qada Salaat instead of Nawaafil Salaat.[9]

4) In principle, the fast would remain intact as long as the water or any substance does not pass beyond the throat. However one should abstain from doing so as it would lead to Karaahat (Abominable).[10]

5 وأورد أن قراءة الإمام خلف عن قراءة المقتدي ، لقوله صلى الله عليه وسلم { من كان له إمام فقراءة الإمام له قراءة } وأجاب ح بأن المراد بالخلف : خلف يأتي به من فاته الأصل . وهاهنا ليس كذلك ا هـ وهو أحسن مما في ط من أنه ليس المراد في الحديث الخلفية بل المراد أن الشارع منعه عن القراءة واكتفى بقراءة الإمام عنه .

6 أدرك الإمام في القيام يثني ما لم يبدأ بالقراءة ، وقيل في المخافتة يثني ، ولو أدركه راكعا أو ساجدا ، إن أكبر رأيه أنه يدركه أتى به .

فافهم ( قوله أو ساجدا ) أي السجدة الأولى كما في المنية ، وأشار بالتقييد براكعا أو ساجدا إلى أنه لو أدركه في إحدى القعدتين فالأولى أن لا يثني لتحصيل فضيلة زيادة المشاركة في القعود وكذا لو أدركه في السجدة الثانية..
