A Mobile Phone Situation and Nikah

Answered as per Hanafi Fiqh by Daruliftaa.com

I have a mobile phone situation. I done a contract from a shop and my credit check never passed. So the shopkeeper let me do it on his wife’s name. It has been over a year, and now the shopkeeper says it’s Haram and it affects the Nikah of the shopkeeper and his wife.

Can you please give me a reply in full detail, as far as I know his wife does not have a problem with it, I have never spoke, seen or heard the shop keepers wife.

ANSWER

In the name of Allah, Most Compassionate, Most Merciful,

The Nikah (marriage) of the shopkeeper is not affected in any way by you having your mobile phone on his wife’s name. It is permissible for you to have your phone on her name. However, if the shopkeeper is uneasy about it and he does not want you to use his wife’s name, then it will not be permissible. He has a right to stop you from using her name. And also this is better, so you do not have any sort of connection with her what so ever.
