To accept husbands earnings from a taxi brought on interest

Answered as per Hanafi Fiqh by DarulIftaBirmingham

My husband has been out of work for a few years and I have been supporting him as I work full time. I have also been paying off his loans. Now he has bought himself a car on interest based finance so that he can be a taxi driver. I am against interest-based finance. Also he had to insure his car, which also involves interest. Will it be permissible for me and my children to accept earnings from his taxi driver job?

 Answer:

With regards to your question, the nature of your husband’s job is something, which is lawful, therefore, the money in itself is lawful and it will be permissible for you and your children to use it. Your husband will be sinful for buying the taxi on interest.

In the Holy Qur’an Allah subḥānahu wa ta'āla (glorified and exalted be He) has said:

“Allah has permitted transactions and has forbidden riba” (Surah Al Baqarah v.275)

The Prophet of Allah ṣallallāhu 'alayhi wa sallam (peace and blessings of Allāh be upon him) has cursed the person who takes interest, who gives interest and who writes it and who witnesses it.” (Mishkaatul-Masabeeh p.244 v.1)

The Prophet of Allah ṣallallāhu 'alayhi wa sallam (peace and blessings of Allāh be upon him) “To take dirham of interest knowingly is worse than committing adultery 36 times.” (Mishkaatul-Masabeeh p.246 v.1)
