Unlawful wealth for Islamic institutions

Answered as per Hanafi Fiqh by DarulIftaBirmingham

You wrote in a previous answer, “The conclusion we can come to is that it was impermissible for you to sell the guitar and the money you gained was unlawful. This money should be given to charity without the intention of reward. (Raddul Muhtar p.553 v.9)”

We are going to set up an Islamic association in our city and we are in need of funds to pay rent etc.; the concerned brother asks if it would be permissible to donate this unlawfully gained money to this Islamic association (not a proper masjid)?

In the name of Allah, the most Beneficent, the most Merciful.

Answer

Sayyiduna Abu Hurairah Radiallahu Anhu narrates that the Prophet of Allah Sallallahu Alahi Wasalam said: “Allah (SWA) is pure and accepts only that which is pure” (Sahih Muslim)

To give unlawful money to a Masjid or any Islamic institutions is unlawful and impermissible. (Fatawa Mahmoodiyah p.193 v.5) However, if one states that the money provided is from lawful wealth then it will be permissible to accept. (Fatawa Hindiyyah p.343 v.5)

Similarly, if a person’s majority income is lawful and less than half is unlawful, then it will be permissible to accept his donations.
