Husband gave me third talaq after I accused him of cheating

Answered as per Hanafi Fiqh by DarulIftaBirmingham

Aselamualeykum,my husband said the third talaq to me but he was very angry because one of his friends told me or lied to me that he was cheating on me for more than one year.when I heard all what was said to me I went mad & phoned him & acused him & i sweard at him many times & he called me to meet him to talk but on the way to meet me i called him again & i acused him & sweard at him which was not my intention but the word said by his friend was going to make me loose my mind.when he was on the phone to meet me he said i had enough of all off you acusing me & wait ther im coming to breake your neck & he was screaming his head off.when he arrived bec there was alot of people around & he loves me to much to hurt me & with fuming attitude he said talaq to me.we love each other very much & we dont want to leave each other but because he said talaq third time to me we are living apart now. i know it was haram & stupid of me to acuse my husband & swear at him bec of all what i heard & i regret it. please can you tell me in this situation is talaq valid bec it happenned because of some stupid men wanted us apart & filled me with lies & lies made me acused my husband & to swear at him & this made him say talaq to me.

Answer

If a person pronounced three divorces at once or at separate times then three divorces will occur. This can be proven through the following hadiths:

Sayyida A’isha (RA) reports that: A man pronounced three divorces to his wife. She (after her iddah) married another man. The Messenger of Allah was asked whether it was lawful for her to return to the first husband. He said: “Not until they have sexual intercourse.” (Sahih Bukhari)

Sayyiduna Hasan ibn Ali (Allah be pleased with him) said (in a long Hadith, after divorcing his wife): “Had I not heard my father (Ali) narrating from my grandfather The Prophet of Allah (Allah bless him and give him peace) say: “when a man pronounces three divorces, then his wife will no longer remain lawful for him, unless she marries another man”, I would have taken my wife back.” (Sunan Baihaqi)

Therefore, with regards to your question three divorces has occurred and he has now become unlawful for you. (Fatawa Hindiyyah p.526 v.1)
