Do we have a right to our grandfather’s property under Shariah law?

(1) My father died before my grandfather. I want to know do we have any right on the property of our grandfather.
(2) Do we have right on our ancestral graveyard? Please guide me according to the Shariah law.

Answer

(Fatwa: 542/321/L=1434)

(1) If male children of your grandfather are alive then you shall get nothing in the property of your grandfather.
(2) If the ancestral graveyard is waqf (endowed) for the purpose that if any member of family dies then he/she shall be buried therein then you people are eligible to be buried in it as well.

Note: If you want to know something else about the graveyard then explain it and submit your query again.
