Is it permissible to give zakat to a non-syed and receive a gift in return for a syed relative?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
If a person belonging to syed family wants to give his zakat to his relative who is also a syed. I think zakat should not be given to a syed family person. Hence, he has decided to give his zakat to a non-syed person and get back the zakat amount from him as gift. Then he handed over the gift amount to his syed relative. Is it correct procedure. pl. clarify.

Answer

(Fatwa: 1033/1033=M/1429)

It was lawful to give Zakah to a non-syed person if he was entitled to receive it. Then, if he willingly gifted the amount to the syed donor and the syed gave the amount to his syed relative then it is right. But, it is not good for the syed to adopt this trick without exigent need to give Zakah amount to his syed relative.
