Should I take my 12-year-old daughter on Hajj with me?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
My daughter is 12 years old as of now and her periods are yet not started. (1) Can I take her to Hajj with the intention for fardh Hajj from her? (2) Or should I wait for her to start her periods and then take her with us for Hajj? (3) I cannot leave her back here while going on Haj due to some reasons and Hajj is fardh on me. Should I take her with me on Haj or postpone my journey till one more year? I am in dilemma as what should be done as Hajj is already fardh on me? Please guide in detail for the steps I should take.

Answer

(Fatwa: 2152/1247/H=1432)

(1) If she is not adult, her fardh hajj shall not be valid.
(2) It is not necessary to wait.
(3) Take her with you. She would do the rituals of hajj. However, by performing hajj in the age of nonage the hajj shall be considered nafli. Later when she attains puberty if hajj becomes fardh on her, she shall perform hajj, otherwise not. However, if hajj has become fardh on you then you should not make more delay due to your daughter.
