Wife Asking for Divorce

Answered as per Hanafi Fiqh by Askmufti.co.za

Q: My husband and I had a huge fight. In the middle of the fight I said I want a divorce and said it 3 times. Does it count as a divorce if the wife says it? Is there any sort of dua that can make him stop getting angry at every little thing?

A: If the wife asks for divorce, or she utters the word ‘divorce’ or ‘talaaq’ then this is not a divorce in Islam and no talaaq has occurred. The nikah of the couple is still intact. However, when the wife asks for a divorce and the husband responds in the affirmative by saying ‘yes’ or by answering ‘you have it’ or  ‘you’ve got it’ then talaaq will take place even if he did not use the word talaaq himself.  If the wife had asked for 3 talaaq then three would fall, and so forth.

As for your husband’s anger, he needs to go for counselling or spiritual treatment. Ask him to go to local Ulema so that they could counsel and reform him, if Allah so wills.
Whenever you are near him, read this name of Allah Ta’ala” Yaa Waliyyu, Yaa waliyyu. as much as possible.

May Allah Ta’ala give your husband good character and may he learn to control his anger. Aameen
