Acknowledging sympathy from non-Muslim about alcohol being haram.

One in a party, I was offered alcohlic drinks to which I refused.

Everyone was surprised at this and started showing sympathy towards me that I dont drink.

I smiled and acknowledged the sympathy.

Does this constitute Kufr.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Your acknowledgement of sympathy does not constitute kufar.[1] However, you should practice precaution in the future by not attending gatherings in which haram acts take place as this could have detrimental effects and could even put your Deen and Imaan at stake.

[1] وفي الجواهر من قال ليت الخمر أو الزنا أو الظلم أو قتل الناس كان حلالا كفر. وفيه بحث اذ غاية حاله أنه تمنى على الله محالا. ولعل وجه كفره استحسان هذه المعاصي لكن اذا لم يكن على وجه الاستحلال لايكون كفرا في الحال (الروضة الازهر ص502 دار البشائر الإسلامية)

وفي الفتاوى الصغرى الكفر شيء عظيم فلا أجعل المؤمن كافرا متى وجدت رواية أنه لا يكفر ا هـ وقال قبله وفي الجامع الأصغر إذا أطلق الرجل كلمة الكفر عمدا لكنه لم يعتقد الكفر قال بعض أصحابنا لا يكفر لأن الكفر يتعلق بالضمير ولم يعقد الضمير على الكفر وقال بعضهم يكفر وهو الصحيح عندي لأنه استخف بدينه ا هـ .وفي الخلاصة وغيرها إذا كان في المسألة وجوه توجب التكفير ووجه واحد يمنع التكفير فعلى المفتي أن يميل إلى الوجه الذي يمنع التكفير تحسينا للظن بالمسلم زاد في البزازية الا اذا صرح بارادة موجب الكفر فلاينفعه التاويل حينئذ وفي التاترخانية لايكفر بالاحتمال لان الكفر نهاية في العقوبة(بحر ج5 ص125 سعيد)
