Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

1. In the situation in question, one will have to apply one’s discretion to determine the debt by making an estimation[1], perhaps it would be best to make an over estimation of the amount.

With regards to being unaware of the whereabouts of the creditors, one should exercise all possible avenues in getting in touch with the creditors. However, if it is not possible to do so then as a debtor one may absolve himself from the situation by giving the money to the poor and needy as sadaqah[2]. We advise using Muslim welfare organizations to distribute one’s sadaqah.

2. In principle, one is obliged to make qadha for the fasts that were missed during his/her lifetime. In order to make up for the missed fasts, one must calculate the number of months of Ramadhan that was missed from the age of maturity. If one is unable to come to an exact number, an estimation should be made of how many months of Ramadhan where missed.

The method which will be adopted, is that for every missed Ramadhan, make the intention that this is the fast of the first month of Ramadhan that was missed. Once one has completed one month of Ramadhan, one may continue with this intention until he/she has a total conviction that one has completed all the qadha fasts of Ramadhan[3]. Upon completion of one month of fast, begin with the next month and so forth.
