Is a sale with guarantee of buy back permissible?

Is selling with buy back guarantee permissible in islam…detail is that for e.g zaid sells a flat to bakar in ten lakhs and further assures him and says that after three years if you can sell it in more than 20 lakhs its your wish to sell..and if you dont get any buyer in 20 lakhs then dont get tensed..if you want to sell we will buy it in 20 lakhs..this kind of guarantee zaid gives bakar so that bakar gets relaxed that my thing will get sold ..and normally this kind of transactions are taking place here in surat..to attract the customers the builders are doing like this..so is this permissible?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

If the “buy back guarantee” was stipulated as a condition in the sale, the sale is impermissible (fāsid).[1]

If however, the guarantee was made after the sale as a promise on the part of the seller, the sale is valid, and the promise will be morally binding.[2]

[1] بيع المعاملة وبيع الوفاء واحد، وإنه بيع فاسد، لأنه بيع بشرط لا يقتضيه العقد، وإنه يفيد الملك عند اتصال القبض به كسائر البيوع الفاسدة (الفتاوى السراجية، زمزم، ٤٢٢)

[2] اگر بيع كے بعد واپسي كا وعده كيا تو يہ بيع صحيح ہے (أحسن الفتاوى، ج٦ ص٥٠٧) ونقل فيه عن الدر المختار: وقيل بيع يفيد الإنتفاع به، وفي إقالة شرح المجمع عن النهاية: وعليه الفتوى، وقيل: إن بلفظ البيع لم يكن رهنا، ثم إن ذكرا الفسخ فيه أو قبله أو زعماه غير لازم كان بيعا فاسدا، ولو بعده على وجه الميعاد جاز ولزم الوفاء به

وتمامه: لأن المواعيد قد تكون لازمة لحاجة الناس، وهو الصحيح كما فى الكافي والخانية (الدر المختار مع رد المحتار، ج٧ ص٥٤٧)
