If a man performs his hajj, and has not given his wifes mehar yet, is his hajj acceptable?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In principle, if a debtor performs hajj, his hajj will be valid. [1] The debtor should make timeous payments to his creditors or ideally seek permission from them to go for hajj. Shariah has emphasised on the rights of creditors. Consider the following hadith:

سَمِعَ أَبَا هُرَيْرَةَ ـ رضى الله عنه ـ يَقُولُ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ “‏ مَطْلُ الْغَنِيِّ ظُلْمٌ ‏”‏‏

Abu Hurairah (Radiallahu Anhu) that he heard Allah’s Messenger (Salallahu Alayhi Wasallam) said, “Procrastination (delay) in repaying debts by a wealthy person is injustice. (Bukhari-2400)

In the enquired situation the husband has not given his wife her maher hence, it is a debt upon him and he should endeavour to pay his wife her mehar. To delay the payment of mehar is highly resented in Shariah. Consider the following hadith:

عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ ‏ “‏ أَحَقُّ مَا أَوْفَيْتُمْ مِنَ الشُّرُوطِ أَنْ تُوفُوا بِهِ مَا اسْتَحْلَلْتُمْ بِهِ الْفُرُوجَ ‏”

‏‏ The Prophet  (Salallahu Alayhi Wasallam) said: “The conditions most entitled to be abided by are those through which you seek to make halal the private parts (nikah). (Bukhari-5151)

The husband is a debtor to the wife. He should make arrangements with her and then proceed for hajj. [2]

[1]قوله ( ممن يجب استئذانه ) كأحد أبويه المحتاج إلى خدمته والأجداد والجدات كالأبوين عند فقدهما وكذا الغريم لمديون لا مال له يقضي به والكفيل لو بالإذن فيكره خروجه بلا إذنهم كما في الفتح وظاهره أن الكراهة تحريمية ولذا عبر الشارح بالوجوب وزاد في البحر عن السير وكذا إن كرهت خروجه زوجته ومن عليه نفقته اه  والظاهر أن هذا إذا لم يكن له ما يدفعه للنفقة في غيبته قال في البحر وهذا كله في حج الفرض أما حج النفل فطاعة الوالدين أولى مطلقا كما صرح به الملتقط قوله ( حتى يلتحي ) وإن كان الطريق مخوفا لا يخرج وإن التحى بحر عن النواز (الرد المحتار ج2 ص456 سعيد).
