Is crab Halaal?

I was searching for a question “is crab halal or haram in Islam” I got that it’s haram in Hanafi maslak & halal in Shafai…can you elaborate about it. If someone says “Kalima” is haram in hanafi & halal in shafai how can you clarify. And also I need to know about other living things in water which are Haram in “Islam”.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

You seek clarity on how can one declare the kalima halal according to the Shafi Mazhab or haram according to the Hanfi Mazhab. Please clarify what you mean as there is no issue of kalmia being halal or haram.

It is on the basis of this misunderstanding that you probably didn’t understand the ruling on the crab according to the different Mazahib. It is important that you understand that there are two types of rulings in Deen. Some rulings are clearly mentioned in the Quraan and Hadith and cannot be academically contested. [1] The second type of rulings are those that are not expressly mentioned in the Quraan or Hadith, and require guidance from the Mujtahids. The Mujtahids are those great Ulama who are experts in all fields of Shariah. They understand every aspect of the Quraan and Ahadith and have the expertise to deduce rulings from the Quraan and Ahadith.

Crab being halal or haram falls in the second category. According to the Hanafi Mazhab crab is haram while according to the Shafi Mazhab it is halal.

As Muqalids, (followers of a school of thought) we are bounded to following the rulings of the Mazhab we are following. Furthermore, we respect the differences of other Mazhabs and tolerate them. You may refer to the following links for more details on the issue of Taqleed.

]3[(قال: ولا يؤكل من حيوان الماء إلا السمك) ش: أي قال القدوري – رَحِمَهُ اللَّهُ – في ” مختصره “: وقال الكرخي – رَحِمَهُ اللَّهُ -: كره أصحابنا كل ما في البحر إلا السمك خاصة فإنه حلال أكله إلا ما طفى منه فإنهم كرهوه. وقال شيخ الإسلام خواهر زاده: ويكره أكل ما سوى السمك من دواب البحر عندنا كالسرطان، والسلحفاة، والضفدع وخنزير الماء ( البناية شرح الهداية ج 14، ص 329 ، مكتبة حقانية)

(ويكره) أي لا يحل (أكل الضبع) لأن له ناباً (والضب) دابة تشبه الجرذون لورود النهي عنه، ولأنه من الحشرات (والحشرات) وهي صغار دواب الأرض (كلها) : أي المائي والبري كالضفدع والسلحفاة والسرطان والفأر والوزغ والحيات لأنها من الخبائث (اللباب في شرح الكتاب592 ، بشار بكري

ولا يوكل من حيوان الماء و هو الذى يكون مثواه و عيشه فى الماء عندنا لقوله تعالى و يحرم عليهمالخبائث الا السمك بانوعه …{ويحرم عليهم الخبائث} [الأعراف: 157] وما سوى السمك خبيث «ونهى رسول الله – صلى الله تعالى عليه وسلم – عن دواء يتخذ فيه الضفدع ونهى عن بيع السرطان» والصيد المذكور فيما تلا محمول على الاصطياد وهو مباح فيما لا يحل والميتة المذكورة فيما روي محمول على السمك وهو حلال مستثنى عن ذلك لقوله – عليه الصلاة والسلام – «أحلت لنا ميتتان ودمان أما الميتتان فالسمك والجراد وأما الدمان فالكبد والطحال» (مجمع الأنهرج2 ص514  دار إحياء التراث العربي)
