Wali for Nikah

Answered as per Hanafi Fiqh by Askimam.org

I wanted to ask you if you can do me a favour.I know a girl. She converted to islam.Since that time she has no wahli in islam because her dad is christian. So i wanted to ask if you can be her wahli and if you can help us in nikah procedure?I know this sounds strange but we live in one city and if only you could have helped us in calling for 2 witnesses and saying nikah words through skype we would be so happy. Can you help us? Jazakallahu Khayran

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In principle, according to the Hanafi Madhab, a mature girl (baligah) has an independent right to get married according to her wish. She does not require the consent of her wali. If the Nikah was conducted in the presence of two male witnesses or one male and two female witnesses, then the Nikah will be valid[1].

You may contact the Imam of your local Masjid, or an Alim in your city to perform the Nikah.

He will guide you in the procedure of the Nikah. Do inform him that your wife has adapted the Hanafi Madhab in which case she does not require a Wali.
